Most immigrants who receive a green card based on their marriage to a U.S. Citizen or Lawful Permanent Resident receive a conditional green card that expires in two years. To avoid serious immigration consequences, two-year conditional green card holders must timely apply to remove conditions and receive a 10-year green card.

Basic Eligibility Requirements

Eligibility for the Removal of Conditions is determined on a case-by-case basis. The general requirements for this application are:

• Have received a conditional green card through marriage to a U.S. Citizen or permanent resident.
• File Form I-751 within the 90-day period before your conditional green card expires.
• Provide evidence that your marriage is genuine and ongoing (or that it was entered into in good faith, even if divorced or widowed).
